Neon Safety - General Terms and Conditions

1. Introduction

These Terms and Conditions govern all transactions with Neon Safety (Test & Tag | Fire Safety) (“the Company”), whether conducted via neonsafety.com.au, email, phone, or in person. By engaging our services or purchasing our products, you acknowledge that you have read, understood, and agreed to be bound by these terms.

2. Service Scope and Standards

  • Compliance Framework:All services are performed in accordance with relevant Australian Standards, including but not limited to AS 1851 (Fire Maintenance), AS/NZS 3760< (Electrical Safety), AS 2444 (Portable Fire Equipment), and AS 2293.2 (Emergency Lighting).
  • Plumbing Disclaimer:Neon Safety provides routine inspection and testing for Fire Hydrant Systems and Fire Hose Reels. We do not provide plumbing services. Any repairs, system modifications, or full installations of pressurized water systems must be performed by a licensed plumber.
  • Service Reporting: Following the completion of on-site testing, a compliance report or asset register will be generated. These documents remain the property of Neon Safety and will only be released to the Client once the full invoice amount has been settled.

3. Service Area and Scheduling

  • Perth Metro Boundary: On-site services are strictly limited to the Perth Metropolitan area (Postcodes 6000–6199, 6800–6999).
  • Site Access: The Client must ensure clear and safe access for our technicians. If a technician attends a site and cannot perform the work due to lack of access, locked premises, or unsafe conditions, a standard call-out fee will apply.
  • Cancellations: We require at least 24 hours’ notice to reschedule or cancel a booking. Failure to provide notice may incur a cancellation fee to cover administrative and logistical costs.

4. Pricing and Payment

  • GST: All prices are in Australian Dollars (AUD) and are inclusive of GST unless stated otherwise.
  • Payment Methods: We accept secure online payments via Stripe or Cash on Delivery (COD) for on-site services.
  • COD Terms: Where COD is selected, the technician requires full payment before compliance tags are finalized or documentation is handed over.
  • Retention of Title: Ownership of all hardware (extinguishers, kits, signs, etc.) remains with Neon Safety until the invoice is paid in full.

5. Installation and Surface Suitability

  • Quotes for Installation: Any installation price provided online or via phone is an estimate based on standard surfaces (brick, timber, or plasterboard).
  • Liability for Mounting: While we take all care during installation, Neon Safety is not responsible for damage caused by mounting equipment to non-standard, fragile, or deteriorating surfaces. If specialized wall fixings are required, additional costs may apply.

6. Compliance and Liability

  • Occupier Responsibility: While Neon Safety provides professional testing and high-quality equipment, the final legal responsibility for site-wide safety compliance and the determination of equipment suitability for specific hazards remains solely with the Business Owner or Occupier.
  • Limitation of Liability: To the maximum extent permitted by Australian Consumer Law, Neon Safety shall not be liable for any indirect, incidental, or consequential damages (including loss of life, property damage, or business interruption) resulting from fire events, electrical faults, or equipment failure. Our testing is a preventative measure at a specific point in time and does not guarantee future performance.

7. Returns and Refunds

  • Professional Services: Fees for on-site inspections, Test & Tagging, and RCD testing are non-refundable once the technician has attended the site and commenced the service.
  • Hardware Returns: Unused hardware in original packaging may be returned within 14 days for a refund (less a 15% restocking fee). We cannot accept returns for items that have been mounted, commissioned, or tagged with site-specific data.

8. Governing Law

These terms are governed by the laws of Western Australia. Any disputes arising from these terms shall be handled within the jurisdiction of Western Australian courts.

  • AS 1851-2012 for routine service of fire protection systems and equipment
  • AS/NZS 60335.2.25:2020 for microwave leakage testing

3. Booking and Payment

  • Bookings can be made via our website, phone, or email.
  • Payment is due upon completion of services unless otherwise agreed in writing.
  • We accept payments via bank transfer, credit card, or other methods specified on our invoices.
  • A deposit may be required for large or ongoing projects.

4. Cancellation and Rescheduling

  • Cancellations must be made at least 24 hours before the scheduled appointment.
  • If our technician arrives on-site and is unable to perform services due to lack of access or other unforeseen circumstances, a call-out fee may apply.

5. Liability and Warranty

  • Neon Safety is not responsible for any pre-existing electrical faults, hazards, or failures discovered during testing.
  • Our test results are valid at the time of inspection. Subsequent equipment damage, tampering, or misuse voids any implied warranty.

6. Customer Responsibilities

  • Customers must provide safe and reasonable access to all electrical equipment and fire safety systems to be tested.
  • Any known hazards or site-specific safety protocols must be communicated before service commencement.

7. Compliance and Reporting

  • Test reports and compliance documentation are provided electronically unless otherwise requested.
  • Clients are responsible for maintaining compliance between scheduled inspections.

8. Privacy Policy

  • We collect customer information solely for the purpose of providing services and maintaining compliance records.
  • Customer data will not be shared with third parties except as required by law.

9. Amendments Neon Safety reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website and take effect immediately.
